Topic: Bank Fraud & Case Law Update

Learning Objective: 

At the conclusion of this presentation, participants will be able to:

  1. Identify and distinguish the core risk-allocation frameworks under UCC Articles 3, 4, and 4A, including how liability is assigned among banks, customers, and third parties in negotiable instruments, deposit accounts, and funds transfers.
  2. Analyze recent case law and statutory developments interpreting Articles 3, 4, and 4A, with particular attention to forged signatures, altered items, unauthorized endorsements, and commercially reasonable security procedures.
  3. Evaluate how courts are addressing modern fraud schemes—including business email compromise (BEC), spoofed wire instructions, and check washing—within the existing UCC framework.
  4. Assess the legal standards governing electronic and wire transfers under Article 4A, including authentication, verification procedures, and the impact of customer conduct on loss allocation.
  5. Apply current legal principles to real-world scenarios involving wire fraud and check fraud to determine potential claims, defenses, and litigation exposure for financial institutions and commercial customers.

Cancellation Policy and No Shows

If you have registered and/or paid for an event and you need to cancel, you MUST email info@acfesanantonio.com no later than 7 days prior to the event, unless otherwise indicated in specific event policies, to request a refund and/or cancel your registration. The Chapter must confirm event registrations with the venue within 7 days of the event and any changes after this time period can become a financial cost to the Chapter. Cancellations received less than 7 days prior to events will not be refunded except for exigent circumstances.
